These Terms of Service govern your use of the Dermatech website and your purchase of any Dermatech product. By placing an order, creating an account, or otherwise using this site, you agree to be bound by these terms. If you don't agree with them, please don't use the site or place an order.

These terms are written to comply with South African law, including the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA). Nothing in these terms limits any right you have under those Acts that cannot lawfully be excluded.

1. Who These Terms Apply To

You must be at least 18 years old, or have the consent of a parent or legal guardian, to place an order on this site. By ordering, you confirm the information you provide (name, delivery address, payment details) is accurate and belongs to you or that you're authorized to use it.

2. Accounts

You can check out as a guest or create an account to save your details for future orders. If you create an account, you're responsible for keeping your login credentials confidential and for all activity that happens under your account. If you believe your account has been accessed without your permission, contact us immediately so we can secure it.

We may suspend or close an account if we reasonably believe it's being used fraudulently, to abuse our refund policy, or in a way that breaches these terms.

3. Products, Pricing, and Availability

Product descriptions, images, and pricing on this site are accurate to the best of our knowledge at the time of publishing, but we don't guarantee that every description is entirely error-free. If a pricing or listing error is discovered after you've placed an order, we'll contact you before processing the order and give you the option to proceed at the corrected price or cancel for a full refund.

All prices are listed in South African Rand (ZAR) and include VAT where applicable. We reserve the right to change prices at any time, but a price change won't affect an order you've already placed and paid for.

Stock availability isn't guaranteed until your order is confirmed. If an item you've ordered becomes unavailable after purchase, we'll notify you and offer a refund or the option to wait for restock.

4. Orders and Payment

Placing an order through checkout is an offer to buy, which we accept once your payment is processed and you receive an order confirmation email. We accept payment via PayPal and other methods shown at checkout. Payment must clear before an order enters processing.

We reserve the right to refuse or cancel any order, including after payment, in cases of suspected fraud, pricing errors, or where we reasonably believe an order breaches these terms. If we cancel an order after payment, you'll receive a full refund.

5. Shipping and Delivery

Orders are shipped within South Africa only, in line with our separate Shipping Policy, which forms part of these terms. Delivery timeframes stated on the site are estimates provided by our courier partners and aren't guaranteed delivery dates.

6. Product Use and Medical Disclaimer

Dermatech is a cosmetic, non-invasive device intended for general body contouring and skin firming use as described on our product pages. It is not a medical device, and it is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Individual results vary based on factors including skin type, consistency of use, and body area treated. The testimonials, before-and-after examples, and results timelines shown on this site reflect individual experiences and are not a guarantee that you will achieve the same or similar results.

If you are pregnant, have a pacemaker or other implanted electronic device, have a history of skin conditions, cancer, blood clotting disorders, or any other relevant medical condition, consult a doctor before use. Discontinue use and consult a healthcare professional if you experience unusual pain, irritation, or any adverse reaction. Use of the device is at your own discretion and risk, in accordance with the instructions provided with your order.

7. Intellectual Property

All content on this site, including text, product photography, videos, graphics, logos, and the Dermatech name and branding, is owned by or licensed to Dermatech and is protected by South African and international copyright and trademark law. You may not copy, reproduce, distribute, or use this content for commercial purposes without our prior written permission.

8. User Content and Reviews

If you submit a review, testimonial, photo, or other content to us (including via email or social media, with your permission), you grant us a non-exclusive, royalty-free right to use, reproduce, and display that content in connection with marketing Dermatech, unless you tell us otherwise in writing. You confirm that any content you submit is your own and doesn't infringe on anyone else's rights.

We may remove any submitted content at our discretion, including content that's false, defamatory, or unrelated to genuine use of the product.

9. Prohibited Use

You agree not to use this site to: violate any applicable law; attempt to gain unauthorized access to our systems or another user's account; interfere with the site's normal operation, including through automated scraping or bots; place fraudulent orders or use stolen payment information; or resell Dermatech products under our branding without authorization.

10. Returns, Refunds, and Cooling-Off Rights

Our Refund Policy, available separately on this site, sets out how returns and refunds are handled and forms part of these terms.

Separately, under ECTA, if you conclude this transaction electronically as a consumer, you have a statutory right to cancel your order without reason or penalty within 7 days of receiving the goods, subject to the conditions set out in ECTA (including that certain exclusions may apply, such as goods made to your specification). Where this statutory cooling-off right applies, it operates alongside, and does not reduce, the rights available to you under our 90-day Refund Policy, which in most cases gives you a longer window than the legal minimum.

11. Limitation of Liability

To the maximum extent permitted by South African law, Dermatech will not be liable for any indirect, incidental, or consequential loss arising from your use of the site or the product, including loss of income, loss of data, or loss of opportunity. This limitation does not exclude liability that cannot lawfully be excluded under the Consumer Protection Act, including liability for harm caused by defective goods as contemplated in section 61 of the CPA.

Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under South African law.

12. Indemnity

You agree to indemnify and hold Dermatech harmless from any claim, loss, or damage arising from your breach of these terms, your misuse of the product outside its intended use, or your violation of any law or third-party right.

13. Warranty

Products are covered by any warranty stated on the relevant product page or included documentation at the time of purchase. This warranty is in addition to, and doesn't replace, your statutory rights under the Consumer Protection Act, including your right to receive goods that are reasonably suitable for the purpose for which they're intended, of good quality, and free of defects.

14. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in our practices or legal requirements. The version in effect at the time you place an order is the version that applies to that order. Continued use of the site after changes are posted means you accept the updated terms.

15. Governing Law and Jurisdiction

These terms are governed by the laws of the Republic of South Africa. Any dispute arising from these terms or your use of the site will be subject to the exclusive jurisdiction of the South African courts.
